The actual purchase and registration of a unique domain name is often a quick and easy task. Cybersquatting, Typosquatting and Renewal Snatching

Cybersquatting is the registration or use of a domain name identical or similar to a well-known trademark belonging to someone else with an intention to profit from its goodwill. They may also register variants of the mark, a practice known as Typosquatting. Renewal snatching may also be used to automate the registration of domain names that have recently expired and not renewed by the original owner. Having registered these domain names, cyberquatters may use them to generate pay-per-click revenue for themselves , practice cybersmearing, or offer to sell the domain name to the brand owner at an inflated price.

Being an online brand identity, a domain name effectively functions as a trademark, and it can be argued therefore that any use of a domain name by a person or business not legitimately entitled to use the trademark amounts to infringement. Especially where bad faith intent to profit can be proved, brand owners can usually use respective countries’ Dispute Resolution processes to seek transfer of these domain names for a nominal fee, which is much quicker and less costly than going to court.

Legitimate Use

In the event two or more parties consider themselves “legitimately entitled” and seek ownership of the same domain name, disputes may also arise. In cases where legitimate ownership and use is obvious, the domain name could be recovered via Negotiation.
